Introduction

Welcome to ARKAiD (arkaid.io). This Privacy Policy describes how Midcurve Corp, a Delaware corporation ("Company," "we," "us," or "our"), may collect, use, disclose, retain, and otherwise handle information when you use the ARKAiD website, platform, and related services (collectively, the "Platform").

ARKAiD is a non-custodial marketplace and trading platform for Bitcoin ordinals and digital assets. We do not take custody of your assets, do not possess or control your private keys, seed phrases, or cryptocurrencies, and any blockchain transaction associated with your use of the Platform is initiated and signed by you through a compatible third-party wallet.

By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy. Please note that ARKAiD is currently in an Alpha launch phase. The Platform and its features, including any promotional points systems, are experimental and may be modified, suspended, or discontinued at any time.

Public Blockchain Data vs. Private Platform Data

Because ARKAiD is built around direct on-chain activity, it is important to distinguish between data that is public by design and data that is stored on ARKAiD-controlled systems.

Public Blockchain Data (Not Controlled by Us)

When you use ARKAiD to facilitate or interact with a transaction, your wallet address, transaction hashes, digital asset identifiers, and related transaction details are recorded on a public blockchain. That information is public, visible to anyone with blockchain access, and effectively permanent or immutable due to the nature of public blockchains.

We do not control public blockchains and cannot erase, alter, or suppress blockchain records. Users should not expect us to fulfill deletion, correction, or restriction requests for data that has been published to a public blockchain.

Private Platform Data (Controlled by Us)

This is the off-chain data we collect to operate the Platform, support limited analytics, calculate engagement points, maintain security, and administer the website and related features. This may include your IP address, usage activity, support communications, your wallet address as a platform identifier, and related platform records. This Privacy Policy primarily governs that off-chain Platform data, not information made public by blockchain design.

Information We Collect

We may collect the following categories of information:

A. Information You Provide Directly

  • Communications: If you contact us for support, legal inquiries, bug reports, or other communications, we may collect your email address, name, and the contents of your message.
  • Voluntary Submissions: If you submit forms, survey responses, feedback, or other information directly to us, we may collect that information.
  • Profile or Preference Information: If the Platform offers optional off-chain profile settings or preferences, we may collect the information you choose to provide.

B. Information Collected Automatically

When you access or use the Platform, we and our infrastructure providers may automatically collect certain technical or usage information, including:

  • Wallet Addresses: When you connect a wallet, we may use your public wallet address as your primary platform identifier for product functionality, points tracking, activity association, and platform display features. Because the Platform is wallet-based, your wallet address may effectively function as your account or user identity on the Platform.
  • Login and Security Log Data: IP addresses associated with login activity, browser type, operating system, approximate timestamps, device information, referring URLs, and similar technical data.
  • Usage and Traffic Data: Information about pages viewed, interactions with listings or features, general navigation behavior, and aggregate traffic patterns.
  • Infrastructure Analytics: At launch, analytics are limited primarily to Cloudflare-level DNS, network, edge, and security-related traffic analytics.

C. Information from Public Sources

We may ingest, index, display, analyze, and associate publicly available blockchain data in connection with Platform features. We may also combine public blockchain data with our off-chain records to provide functionality such as activity history, wallet-linked points balances, marketplace views, and other user-facing or administrative features.

How We Use Your Information

We may use the information we collect to:

  • operate, maintain, secure, and improve the Platform;
  • authenticate usage and detect abuse, spam, fraud, suspicious activity, malicious behavior, or policy violations;
  • provide wallet-linked user experiences and interface functionality;
  • administer, calculate, adjust, or remove the ARKAiD points system;
  • understand aggregate usage trends and infrastructure performance;
  • communicate with you regarding support requests, legal matters, product notices, security notices, or policy updates;
  • protect our rights, property, systems, users, and business operations; and
  • comply with legal obligations, enforce our policies, and resolve disputes.

The ARKAiD Points System

ARKAiD may operate an experimental, off-chain points system as an internal engagement metric. The points are purely for measuring user engagement, testing activity, participation, or other platform interactions during the Alpha phase or later phases of operation and possess no monetary value, no backing, and no secondary market functionality.

How Points Data May Be Used

We may use wallet-linked activity, platform usage patterns, on-platform interactions, and related off-chain records to calculate, display, adjust, or remove points balances. We may also determine the criteria, weighting, visibility, correction, forfeiture, or discontinuation of points in our discretion.

No Monetary Value or Guarantees

Points are promotional, experimental, discretionary, and off-chain only. Points:

  • have no cash value;
  • are not redeemable unless we expressly state otherwise in separate written terms adopted by us;
  • are not property;
  • are not tokens, digital assets, or currency;
  • do not create any ownership interest, profit expectation, compensation right, or economic right; and
  • may be modified, revoked, paused, reset, deleted, or discontinued at any time, for any reason or no reason, with or without notice.

Your receipt or accumulation of points does not entitle you to any future utility, reward, governance right, token issuance, distribution, compensation, or other benefit.

How We Share Information

We do not sell your personal information in the ordinary sense of exchanging it for money. We may disclose or make information available in the following limited circumstances:

  • Service Providers and Infrastructure Partners: We may share information with service providers who support hosting, infrastructure delivery, DDoS mitigation, security operations, traffic routing, limited analytics, support systems, or other operational functions. At launch, this may include providers such as Cloudflare and other infrastructure partners.
  • Corporate Transactions: We may disclose or transfer information in connection with a merger, acquisition, financing, restructuring, sale of assets, reorganization, bankruptcy, or similar corporate event.
  • Legal, Regulatory, and Protective Disclosures: We may disclose information where we believe it is necessary or appropriate to comply with applicable law, legal process, governmental request, or to protect the rights, safety, property, systems, or legitimate interests of Midcurve Corp, its users, or others.
  • Public Blockchain Context: If information is included in a blockchain transaction or otherwise derived from public blockchain activity, that information may be inherently available to the public and is not treated as a confidential disclosure by us.

Cookies and Similar Technologies

We and our service providers may use cookies, local storage, and similar technologies in connection with infrastructure delivery, security, performance monitoring, and core platform functionality. At launch, ARKAiD will not present a separate cookie consent banner. This reflects our current limited analytics posture using Cloudflare-level infrastructure and may change if our data practices or legal obligations change.

Where such technologies are used, they are intended to help support site operation, mitigate abuse, improve performance, and understand high-level traffic patterns through infrastructure providers such as Cloudflare. You can instruct your browser to reject or limit certain cookies or related technologies, but doing so may reduce functionality or impair your ability to use some parts of the Platform.

Data Security

We use commercially reasonable measures intended to help protect the security of Platform data under our control. However, no method of transmission over the Internet and no method of electronic storage is completely secure. We do not guarantee absolute security, uninterrupted availability, or freedom from unauthorized access, loss, misuse, or alteration.

Because ARKAiD is non-custodial, the security of your wallet, private keys, seed phrases, credentials, devices, and transactions is your responsibility and the responsibility of your chosen wallet provider or other third-party tools. We are not responsible for compromise of your wallet, signing device, credentials, local environment, or blockchain transactions you authorize.

Data Retention

We retain Platform data for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, resolve disputes, enforce agreements, maintain security, and comply with legal obligations.

As part of our current operational practice:

  • login-related IP data is retained for up to six (6) months and then purged; and
  • we do not maintain separate wallet session data beyond the wallet address itself and related records reasonably needed to operate the Platform.

We may also retain certain records for longer where reasonably necessary to investigate abuse, protect the Platform, defend legal claims, or comply with law. Retention periods may change over time based on operational, legal, compliance, or security needs.

Your Rights and Requests

Depending on your location and applicable law, you may have certain rights regarding off-chain personal data we hold about you, such as the ability to request access, correction, or deletion.

You may submit requests using the contact details below. We may request additional information to verify your identity before acting on a request, including where appropriate information reasonably necessary to confirm control of a wallet address associated with the relevant off-chain record.

Important Limitations

Your rights apply only to off-chain personal data under our control. We cannot delete, alter, or restrict public blockchain data. A wallet address may function as your platform identity, but public blockchain activity tied to that address exists independently of our systems and may remain visible even if related off-chain data is deleted.

We may be unable to fully disassociate or anonymize blockchain-linked activity where such activity is publicly recorded on an immutable blockchain or remains reasonably necessary to operate, secure, investigate, or defend the Platform. We also reserve the right to retain or decline to act on requests where permitted by applicable law, including where we cannot reasonably verify identity, where doing so would undermine security, or where retention is necessary to comply with law, detect abuse, resolve disputes, or enforce our legal rights.

International Data Transfers

Midcurve Corp is based in the United States. If you access the Platform from outside the United States, your information may be transferred to, stored in, or processed in the United States or other jurisdictions where we or our service providers operate.

Those jurisdictions may not provide the same level of data protection as your home jurisdiction. By using the Platform, you acknowledge and understand that your information may be transferred internationally in this manner.

Children's Privacy

The Platform is not directed to children and is not intended for use by individuals under the age of 18. We do not knowingly collect personal information directly from children under 18. If you believe a child has provided us with personal information, contact us and we will take commercially reasonable steps to review and address the issue.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our business, technology, risk posture, data practices, legal obligations, or the evolution of the Platform beyond Alpha. We will post the updated version on this page and revise the Effective Date above.

Your continued use of the Platform after an updated Privacy Policy becomes effective constitutes your acknowledgment of the revised policy.
